1. NiceSexToys is a trading name of BTH Holdings, which is a UK company registered in England and Wales (No. 4258735) at The Beresford Centre, Wade Road, Basingstoke, Hampshire, RG24 8FA.
2. By using this website, You agree to be bound these terms and conditions. If you do not agree to be bound by our terms, you must not use this website for any purpose.
3. Your statutory rights are not affected by these Terms and Conditions, but, we reserve the right to refuse to supply goods or services at our discretion and without further explanation.
4. We cannot be held responsible for any injury caused by improper use of any of the items sold on this site. If you are in doubt as to how to use goods please contact us and we will explain.

2. This website contains content of a sexual nature. While we try and keep things as tasteful as possible, some users may find the material offensive. We accept no liability for offence caused. We accept no liability for any site not owned by us which may act as a portal to this website or is connected by a link. We accept no liability for any site not owned by us which we may link to.

Offer and acceptance

1. A binding contract is formed between you and BTH Holdings when you receive confirmation from us by e-mail, telephone or other means that your order has been despatched. Please note that regardless of the name of the website you bought products on, the contract is between you and BTH Holdings

Prices

1. The price you pay is displayed clearly on the website and includes Value Added Tax for EU residents. We accept no responsibility for collection of taxes for customers outside the EU.
2. We check the website daily to ensure that our pricing is correct. In the instance that our prices are displayed incorrectly, we will notify you of the error prior to despatch of the goods and give you the opportunity to cancel your order should you wish.
3. Our prices are set in pounds sterling, but if you are buying from overseas you may be charged in local currency.

Delivery

1. All orders will be picked and despatched within one working day of the order being received. If items are out of stock, you will be contacted by one of our team who will ask you how you would like to proceed.
2. All orders are sent Recorded Delivery via Royal Mail and incur picking and packing fees which are clearly outlined elsewhere on this site adn which are clearly displayed to you before you pay for goods. All orders require a signature at the delivery point. If you instruct the courier company to leave products unattended, we will not be responsible for loss.
3. We may charge extra for delivering goods overseas based on the weight of the parcel and the destination.
4. All orders will be despatched in plain packaging.
5. We reserve the right to amend our mailing policy any time

Returns / Cancellation of orders under UK law (UK customers only)
This site trades in accordance with recent EU directives for online trading as follows:

1. All goods come with a 14 day no quibble guarantee. If for any reason at all you are not happy with what you've bought simply return it to us within 14 days of placing your order and we will exchange it for an alternative product or refund your money. Please note that postage and packaging costs are non-refundable. HOWEVER,
2. The product(s) must be unused. We simply will not accept returned products that are soiled - think about hygiene.
3. The product(s) must be in its original condition and in the box or packaging in which it arrived
4. We must receive the product within 14 days from order being completed.
5. We do not refund postage and packaging
6. Returned products that are not defective will be subject to a £2.00 handling fee. This will be deducted from your refund
7. You must also return all free products given to you by us at the time of purchase, or we will deduct the cost of those products (RRP) from your refund
8. Personalised goods or made to order goods are excluded.
9. To cancel you should telephone 0870 850 4558 or write to the address above, clearly marking the envelope "RETURNS" within seven days of delivery of your items, quoting your order number. You will be given a return number that must be used when returning your goods.

Security & Data Protection

1. We provide a secure checkout for the encrypted delivery of sensitive customer information such as contact and credit card details.
2. We do not store your credit card details
3. We hold your order details on a secure database for the purpose of fulfilling orders. If you opt out of receiving discount codes, you will not be sent promotional communication
4. Your credit card details are not held by us and cannot be accessed after an order has been placed

Unlawful Provision

1. If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be excluded and shall not affect the validity and enforceability of the remaining terms and conditions.

Governing law and jurisdiction

1. This contract is subject to the law of England and Wales. All disputes arising out of this contract shall be subject to the exclusive jurisdiction of the courts of England and Wales. Those who access the site from other locations are responsible for compliance with their local laws and taxes as applicable.
2. Any disputes not resolved by normal complaints procedure will be resolved exclusively in the courts of England and Wales under English Law.
